Terms of Service

Version 2026-10-22. Last updated October 22, 2026.

Effective date: 22 October 2026

These Terms of Service (the "Terms") are a binding agreement between you and Social Muse, Nepal ("Social Muse", "we", "us", "our"). They govern your use of the Social Muse website at socialmuse.online, the Social Muse web application, mobile applications, APIs and related services (together, the "Service").

By creating an account, starting a free trial, buying a plan, accepting an invitation or otherwise using the Service, you agree to these Terms. If you use the Service for a company or other organisation, you confirm that you have authority to bind it, and "you" means that organisation. If you do not agree, do not use the Service.

These Terms incorporate our Privacy Policy, Refund Policy, Cookie Policy and, where it applies, our Data Processing Agreement.

1. The Service

Social Muse helps businesses, creators and agencies create content, publish and schedule it to connected social media accounts, manage comments and messages as leads, and research their market with AI-assisted tools (including SEO, competitor, keyword and backlink research).

Features, limits and supported social platforms depend on your plan and may change over time. Some features depend on the APIs and policies of third-party platforms and are only available where those platforms permit them.

2. Eligibility

You must be at least 18 years old to create an account, to be invited to a workspace, or to use the Service. By using the Service you confirm that you meet this requirement and that you are not barred from using the Service under any applicable law.

3. Accounts, workspaces and roles

  • Owner. The person who creates a workspace and buys its plan. The Owner controls the workspace, its members, its connected accounts and its billing.
  • Collaborators. People an Owner (or a Collaborator with the right permission) invites to a workspace. Each Collaborator can only read, create or update the parts of the workspace they have been given access to.
  • Responsibility for your team. The Owner is responsible for everyone they invite and for the access they grant, including anything a Collaborator posts, connects or changes.
  • Accurate information and security. You must give accurate information, keep your password and any two-step verification secure, and tell us promptly at support@socialmuse.online if you believe your account has been accessed without your permission. You are responsible for activity under your account.
  • Device and session limits. Your plan may limit the number of devices or sessions that can be signed in at once.

4. Free trial

  • A new account may receive a free trial (currently 3 days). The free trial is given once per account, on the first plan started by any of that account's workspaces.
  • A payment card is required to start the trial. At the end of the trial, the plan you chose renews automatically and your card is charged the price shown at checkout, unless you cancel before the trial ends. We show this before you enter your card details.
  • Trial workspaces may have lower limits than the paid plan (for example, fewer connected platforms or collaborators).

5. Plans, prices and payment

  • Plans and prices. Plans, their features, limits and prices are shown on our pricing page and at checkout. Prices are in US dollars (USD) and are billed monthly or yearly in advance, as you choose.
  • Merchant of record. Payments are processed by our payment partner and merchant of record, Dodo Payments. Dodo Payments is the seller of record for your purchase, processes your card and collects any applicable sales tax, VAT or GST, which is shown at checkout. Dodo Payments' own terms also apply to the payment. We never see or store your full card number.
  • Automatic renewal. Your plan renews automatically at the end of each billing period and the renewal price is charged to your payment method until you cancel.
  • Price lock. While your subscription stays active without a break, you keep the price and the plan limits you bought. Changes we make to a plan apply to new purchases. If you upgrade, or buy again after your plan has ended, the price and limits of that plan at that time apply.
  • Upgrades only. You can move to a higher plan at any time; the difference for the rest of the current period is charged pro rata at the time of the upgrade. You cannot move to a lower plan during a paid period. To move to a lower plan, let your current plan end and buy the lower plan.
  • Failed payments. A payment counts only once our payment partner confirms it. If a renewal payment fails, we may retry it and may pause access to paid features until it succeeds.
  • Coupons. Promotional codes apply only as stated with the code, cannot be exchanged for cash and may end at any time.
  • Taxes. Prices exclude taxes unless stated. Applicable taxes are calculated and collected by Dodo Payments at checkout.

6. Cancellation, expiry and refunds

  • Cancelling. You can cancel at any time from Billing in the app (or the customer portal linked from it). Cancelling stops future renewals; your plan stays active until the end of the period you have paid for.
  • Refunds. Payments are non-refundable except as set out in our Refund Policy, which also explains how we extend your plan when our own failure or maintenance stops you from using the Service, and what applies where the law gives you a right to a refund.
  • After expiry. When a plan ends and is not renewed, the workspace can no longer use the Service until a plan is bought again. Workspace data is kept locked (not deleted) for 90 days after expiry and is then removed from the Service unless a plan is bought again within that time, as described in our Privacy Policy.

7. Connected social media accounts

  • When you connect a social media account, you authorise us to access that account and act on your behalf within the permissions you grant, such as publishing posts, reading comments and messages, and reading performance data.
  • You must comply with the terms, policies and community guidelines of every platform you connect. If you connect a YouTube account, you also agree to be bound by the YouTube Terms of Service.
  • Third-party platforms decide what their APIs allow and may change, limit or withdraw access at any time. We are not responsible for a platform's actions, including rejected posts, rate limits, reduced reach, suspensions or account bans, or for features that become unavailable because a platform changes its API.
  • You can disconnect an account at any time from Connected platforms. Disconnecting stops our use of that account from then on.

8. Your content

  • Ownership. You keep all rights in the content you upload, create or publish through the Service ("Your Content"), including text, images, videos and AI-assisted output you choose to use.
  • Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transform (for example, transcode video), display and transmit Your Content only as needed to provide, secure and support the Service for you, including publishing it to the accounts you choose and processing it with the AI features you use. This licence ends when Your Content is deleted from the Service, except for copies kept in backups for a limited time or where the law requires us to keep them.
  • Your responsibility. You confirm that you have all rights and permissions needed for Your Content and for any personal data it contains, and that publishing it does not break any law or anyone's rights.

9. AI features

  • The Service uses third-party AI providers to generate captions, ideas, replies, lead scores and research. AI output can be inaccurate, incomplete or similar to output produced for others.
  • Research figures such as search volume, keyword difficulty, rankings and backlink counts are AI estimates, not measured data, and are labelled as such.
  • You are responsible for reviewing AI output before you use or publish it. Nothing is published without approval unless you (or your Owner) turn on automatic publishing for a platform.
  • We do not use Your Content to train our own AI models. We send an AI provider only what is needed for the action you request, through that provider's API service, as described in our Privacy Policy.

10. Acceptable use

You must not use the Service to:

  1. Break any law or regulation, or infringe anyone's intellectual property, privacy or other rights.
  2. Publish content that is unlawful, defamatory, harassing, hateful, sexually exploitative, violent, deceptive or that promotes illegal activity.
  3. Send spam, run fake engagement, impersonate others, or manipulate platforms in a way their rules forbid.
  4. Collect or process personal data without a lawful basis, or upload special categories of personal data (such as health data) unless you are permitted to.
  5. Get around plan limits, permissions, device limits, rate limits or any security measure, or access workspaces or data that are not yours.
  6. Probe, scan or test the Service for vulnerabilities, except as allowed in our Security page, or interfere with its operation (including through malware or excessive automated requests).
  7. Copy, resell, sublicense or reverse-engineer the Service, or use it to build a competing product.

We may remove content or restrict access where we reasonably believe these rules have been broken.

11. Our intellectual property

The Service, including its software, design, templates, text, logos and the "Social Muse" name, belongs to us or our licensors and is protected by law. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms while your plan is active. All other rights are reserved. If you send us feedback, we may use it freely without any obligation to you.

12. Privacy and data protection

Our Privacy Policy explains how we handle personal data. Where we process personal data on your behalf (for example, data about your leads, followers or team), our Data Processing Agreement applies and forms part of these Terms.

13. Availability and changes to the Service

We work to keep the Service available and secure, but it is provided over the internet and depends on third parties, so we do not promise that it will be uninterrupted or error-free. We may carry out maintenance, which we try to schedule at quiet times and announce in advance in the app where we can. If our own failure or maintenance prevents you from using a paid plan, our Refund Policy explains how we extend your plan.

We may improve, change or remove features. If a change materially reduces the core features of a plan you have paid for, we will tell you in advance.

14. Suspension and termination

  • You may stop using the Service and cancel your plan at any time.
  • We may suspend or close your account or workspace, with notice where reasonable, if you materially break these Terms, do not pay, create a security risk, or if the law requires us to. Where the breach can be fixed, we will usually give you a chance to fix it first.
  • On closure, your right to use the Service ends. Sections that by their nature should survive (including 8, 11, 15, 16, 17 and 19) continue to apply.

15. Disclaimers

Except as expressly stated in these Terms, and to the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular result from using the Service, such as followers, reach, leads, rankings or sales.

16. Limitation of liability

To the fullest extent permitted by law:

  1. Neither party is liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, arising out of or relating to these Terms or the Service.
  2. Our total liability for all claims arising out of or relating to these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

These limits do not apply to liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence. If you are a consumer, nothing in these Terms affects rights you have under mandatory consumer law in your country.

17. Indemnity

You will defend and indemnify Social Muse against claims, losses and reasonable costs (including legal fees) arising from Your Content, your use of connected platforms, or your breach of these Terms or of the law, except to the extent caused by our own breach.

18. Changes to these Terms

We may update these Terms. For material changes, we will notify you by email or in the app at least 15 days before they take effect. If you do not agree, you can cancel before the change takes effect; continuing to use the Service after that date means you accept the updated Terms.

19. Governing law and disputes

These Terms are governed by the laws of Nepal, without regard to conflict-of-law rules. Before starting any formal proceedings, both parties will try in good faith to resolve the dispute by contacting the other in writing, for at least 30 days. Disputes that cannot be resolved this way will be decided by the competent courts of Nepal. If you are a consumer, you may also have the right to bring proceedings in the courts of the country where you live, and the mandatory consumer protection laws of that country continue to apply.

20. General

  • Entire agreement. These Terms, with the documents they refer to, are the whole agreement between you and us about the Service.
  • Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of our business, with notice to you.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in force.
  • No waiver. Not enforcing a right is not a waiver of it.
  • Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, such as natural disasters, war, power or internet failures, or failures of third-party platforms or providers.
  • Language. These Terms are written in English. Translations are provided for convenience only; if they differ, the English version governs.
